The Tier 1 (Entrepreneur) route is notoriously complex following the introduction of the ‘genuine entrepreneur’ test and other measures aimed at tackling alleged abuse. The current refusal rate for such applications runs at almost 50% globally and many applications take months to process.
Against this backdrop we are delighted to have secured leave to remain as a Tier 1 (Entrepreneur) for one of our clients in just over five weeks from the date the application was filed to the date the Biometric Residence Cards for our client and his family members were issued. We have also maintained a 100% success rate for Tier 1 (Entrepreneur) applications.
Our client, a highly talented entrepreneur, was seeking to establish an innovative business in the UK. Our services included reviewing his business strategy with him and ensuring that he not only had, but was able to provide evidence of, his relevant business and educational experience. We introduced our client to an experienced accountant who was able to provide him with relevant advice on the financial aspects of his business case and we provided advice on the specific evidence required, including third party references and detailed evidence of the research our client had undertaken to ensure that his plan was viable. A key part of our role was to ensure that enough evidence was provided to the Home Office to enable them to make an informed decision on the case, without providing too much evidence which can of itself lead to delays in the process.
Against various time-pressures, we worked quickly and collaboratively with our client, his referees and other advisors and prepared the application thoroughly. Because our client’s application was strong on the papers alone, he was not required to attend an interview at the Home Office. Our client is now able to focus fully on establishing his business in the UK and we are delighted to have been able to deliver this early Christmas present to him and his family.
Our offices will be closed for the festive season from noon on 24 December until 2nd January inclusive. If you will require legal advice in 2015, please contact us.
Season’s Greetings from all at Carter Thomas Solicitors!
