If you apply for a Tier 4 student visa for the UK and receive a notice of refusal, you have the right to apply for an administrative review of the refusal decision. There are strict time-frames to comply with so it is important to respond quickly.
There are a variety of reasons that may lead to the refusal of a Tier 4 visa application. These can result from a failure to provide mandatory evidence, such as evidence that the maintenance requirement can be met or, where necessary, a TB certificate.
However, refusals can also be on the grounds that the Entry Clearance Officer was not satisfied that the Tier 4 applicant met something called the ‘genuine student’ rule. This can lead to a refusal decision and the way to challenge this is by way of an administrative review.
Strict time-limits
Tier 4 applicants who are outside the UK when a refusal decision is made have 28 days from the date on the notice to file an application for an administrative review.
Those who are in the UK have 14 days to file the application for an administrative review.
Home Office fees
There is no Home Office fee for a Tier 4 administrative review application that is filed from outside the UK.
A Home Office fee of £80 is payable for Tier 4 administrative review applications that are filed from inside the UK. This is refunded if the refusal decision is overturned.

The Home Office seeks to respond to the majority of administrative review applications within 28 days.
Outcome of the Tier 4 administrative review process
If the Tier 4 administrative review is successful, the visa will be granted. However, if the refusal notice is upheld, the only further way to challenge the decision is to apply to the Tribunal for a judicial review.
