We recently highlighted that December’s RCoS allocation was reached.
Unfortunately, January’s RCoS allocation has also been reached and whilst the Home Office is yet to update its information, which they usually do around the 21st of the month, we anticipate that a similar points threshold to that applied in December will have been applied.
Many sponsors will therefore need to file fresh RCoS applications for the February intake, due to close on Monday 5 February and to be decided on Monday 12 February.
Sponsors that are considering increasing the salary for the worker who is to be sponsored, subject to a RCoS being granted, are reminded that a) the new salary must be with in the salary range specified in the Resident Labour Market Test, if required, and b) there must be a genuine intention to pay the new salary to the worker. If the salary is subsequently reduced and UKVI suspect that false information was provided in the RCoS application, this could trigger compliance action against the sponsor.
