Businesses, schools, charities, healthcare providers and others seeking to sponsor non-EEA nationals under Tier 2 of the Points Based System continue to face difficulities.
We have been covering this issue on our commentray pages since the problems first arose in December. Unfortuntely, April’s allocation of Restricted Certificates of Sponsorship was once again oversubscribed.
The Home Office has confirmed that the minumum points threshold for April was 46. This means that applications in relation to roles with remunertion of less than £50,000 would not have been approved unless the Home Office was willing to grant the application on an exceptional basis.
There is nothing to prevent sponsors from re-submitting applications in the May cycle providing the Resident Labour Market Test, where required, remains valid.
